Terms of Service

1. Acceptance of Terms

By accessing or using Alenta AI (the “Service”), you agree to be bound by these Terms of Service (“Terms”) and all applicable laws and regulations. If you do not agree, you must not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Service Description

Alenta AI provides software that turns a customer’s website into an interactive AI agent for lead capture, customer support, and conversion optimization. Features, pricing, and availability may change from time to time.

3. Account Terms

You must provide accurate, complete account information and you are responsible for maintaining the confidentiality of your credentials. You are responsible for all activity that occurs under your account. You may not share accounts, create accounts using automated means, or misrepresent your identity. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

4. Acceptable Use

You agree not to use the Service to: (a) violate any law or regulation; (b) infringe any intellectual property or other right of any third party; (c) transmit malware, viruses, or other harmful code; (d) attempt to interfere with, compromise the integrity of, or gain unauthorized access to the Service or its related systems; (e) use the Service to generate content that is deceptive, discriminatory, defamatory, or otherwise harmful; or (f) resell or sublicense the Service except as expressly permitted in writing.

5. Intellectual Property

Alenta AI and its licensors retain all right, title, and interest in and to the Service, including all software, text, graphics, trademarks, and documentation. You retain all rights in content you submit (“Customer Content”) and grant us a limited, non-exclusive, worldwide license to host, process, and display Customer Content solely as needed to provide and improve the Service. Feedback you provide about the Service is non-confidential and may be used by us without restriction.

6. Third-Party Services

The Service integrates with third-party providers (including but not limited to Stripe for payments, Supabase for database and authentication, and LLM providers such as Anthropic or OpenAI for AI responses). Your use of those services is subject to their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party providers.

7. Fees and Payment

Paid plans are billed in advance on a monthly or annual basis through our payment processor. Fees are non-refundable except where required by law. Taxes, where applicable, are your responsibility. We may modify pricing with at least 30 days’ prior notice; changes apply to your next renewal. Failure to pay may result in suspension or termination of your account.

8. Termination

You may cancel your account at any time from the billing dashboard. We may suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your right to use the Service ends immediately; we will retain and dispose of your data in accordance with our Privacy Policy. Sections that by their nature should survive termination shall survive.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Responses generated by AI may be inaccurate, incomplete, or otherwise unsuitable for your intended use; you are solely responsible for reviewing outputs before relying on them.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALENTA AI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SERVICE. Our aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred United States dollars (US$100), whichever is greater.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in those courts.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be announced via email or in-product notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
